Riporto un’analisi di Felice Lima che trovo di straordinario interesse e che sottoscrivo in toto. Il moralista
Nella magistratura si perpetua da decenni una grave mistificazione della storia: la “magistratura”, intesa sia come istituzione che come associazione, si nasconde dietro le vite e le storie di alcuni “magistrati”.
Dunque, gente come Caliendo, Toro, Miller, Papa, Martone, Marra, Marconi e decine di tantissimi altri sfruttano i nomi e le vite di Falcone, Borsellino, Livatino, e decine di tantissimi altri per accreditarsi agli occhi dell’opinione pubblica, mentre gestiscono un potere di grande rilevanza nella vita democratica del Paese nel modo che è sotto gli occhi di tutti.
Il popolo difende generosamente “la magistratura”, credendo con ciò di difendere la legalità e la giustizia, ma non sa che il potere interno alla “magistratura” non è amico della legalità e della giustizia, tanto quanto non è amico dei magistrati integerrimi e imparziali.
Com’è noto a tutti, i più gravi ostacoli all’opera dei magistrati più bravi e generosi sono sempre venuti dalla “magistratura” e dal Csm.
Voglio commentare qui una delibera approvata ieri con riferimento al caso del magistrato Capo degli Ispettori del Ministero della Giustizia dr Arcibaldo Miller.
Costui risulta coinvolto in vicende veramente gravi e sembra provato che abbia mantenuto condotte decisamente deplorevoli.
Non lo dico come mia opinione personale, ma riportando parole tratte da una bozza della proposta di delibera inviata al Plenum del Csm dalla Prima Commissione, ove era scritto, fra l’altro, che «il dr Arcibaldo Miller ha messo a disposizione (fornendo pareri preventivi, assicurando l’esercizio dell’attività ispettiva non materialmente esercitata per ragioni politiche) il suo ruolo di Capo dell’Ispettorato del Ministero della Giustizia al gruppo associativo segreto al fine di intimidire e punire i magistrati del Tribunale di Milano nell’esercizio delle loro funzioni giurisdizionali» e ancora che «appare evidente che la il dott. Arcibaldo Miller ha tenuto una condotta in aperta violazione dei canoni di imparzialità e indipendenza in quanto: ha partecipato a riunioni nelle quali si esercitavano pressioni politiche anche illecite su organi di rilevanza costituzionale nell’esercizio della giurisdizione; ha posto il suo potere amministrativo a servizio di interessi di parte politici e affaristici. In tal modo dimostrando incapacità di svolgere le proprie funzioni con piena indipendenza e imparzialità» (la delibera approvata in Plenum ha contenuti simili, ma significativamente più blandi di quelli appena riportati).
A fronte di tali fatti gravissimi, vi chiederete: cosa ha fatto in concreto il Csm da un anno a questa parte? Perché i fatti ai quali faccio riferimento sono noti al Csm da un anno. Cosa ha fatto il Csm di concreto nei confronti del Miller?
Cosa ha fatto in un anno quello stesso CSM che in pochi giorni ha cacciato dalla Procura di Salerno i colleghi Apicella, Nuzzi e Verasani, che con le loro indagini stavano dando fastidio proprio ai magistrati legati alla P4 e ai loro amici?
Concretamente proprio un bel nulla, posto che Miller è ancora lì dov’era e c’è ancora come magistrato.
A questo link è possibile leggere l’intero testo della delibera approvata oggi dal Csm e constatare di persona.
Potreste obiettarmi: ma dalla delibera sembra che il Csm abbia le mani legate.
Ma non è vero. Questa delle “mani legate” è una scusa abituale ma bugiarda.
Il Miller sta a fare il Capo degli Ispettori del Ministero come magistrato grazie a una autorizzazione concessagli dal Csm.
Il Csm avrebbe – già da un anno – il dovere di prendere atto che la collocazione del Miller lì dov’è ora non solo non giova all’amministrazione della giustizia, ma le nuoce gravemente e, dunque, revocare illico et immediate l’autorizzazione al fuori ruolo.
E, infatti, in una delle proposte di delibera esaminate dal Plenum del Csm si faceva espresso riferimento alla «eventuale revoca dell’autorizzazione al fuori ruolo in quanto venuti a mancare i presupposti di interesse dell’amministrazione», riferimento poi soppresso nel testo definitivo della delibera approvata.
Al Miller resterebbero così solo due alternative: o ritornare in ruolo, a lavorare in qualche ufficio giudiziario, preferibilmente lontano da questioni delicate e collegate con la politica e il potere, lasciando il posto di Capo Ispettore, o restare nel posto di Capo Ispettore dimettendosi però dalla magistratura.
Ovviamente a un anno di distanza da quando conosce ufficialmente i fatti qui in discussione il Csm si è guardato bene dal dare questo dispiacere al Miller e ai suoi amici potenti.
E, dunque, se domani un avvocato mi denuncerà sostenendo che ho depositato due sentenze in ritardo, io sarò ispezionato… proprio dal Miller!
Quanto questo sia assurdo e paradossale e quali conseguenze si debbano trarre da questo ognuno può valutarlo da sé.
A ciò deve aggiungersi che solo poco tempo fa il dr Apicella, Procuratore di Salerno, è stato sospeso dalle funzioni e dallo stipendio in pochi giorni e poi destituito in pochi mesi, perché ritenuto “colpevole” di avere approvato un decreto di perquisizione ritenuto pienamente legittimo dal Tribunale del riesame, che aveva il torto di dispiacere grandemente proprio agli ambienti della cosiddetta P4.
Ed è inutile sottolineare come non sia in atto nulla di talmente veloce e talmente radicale né nei confronti del Miller né degli altri magistrati coinvolti nelle brutte storie che in questi giorni stanno su tutti i giornali.
Perché nessuno si sogni di dare credito all’altra menzogna secondo la quale la gente fin qui citata non rappresenterebbe “la magistratura” e si tratterebbe di casi isolati di persone non organiche all’ambiente della “magistratura”, segnalo solo un paio di cose:
1. sarà sufficiente mettere i cognomi dei protagonisti di questa storia nella casellina di Google News per scoprire di chi si tratta;
2. comunque, Achille Toro è stato Presidente per anni della corrente Unità per la Costituzione; si è dimesso da Presidente perché coinvolto in una brutta storia nel procedimento di Milano relativo alla scalata di Unipol e, nonostante questo, è stato lasciato a fare il Procuratore Aggiunto di Roma, da dove ha potuto indagare, anche nell’interesse di sé stesso, contro Gioacchino Genchi, adottando anche provvedimenti dichiarati illegittimi dai giudici competenti; infine si è dimesso dalla magistratura, perché indagato per fatti ancora più gravi;
3. Giacomo Caliendo e Antonio Martone sono stati Presidenti dell’Associazione nazionale magistrati;
4. Umberto Marconi è stato membro del Csm.
Insomma, questa gente è molto rappresentativa della “magistratura”, intesa come il sistema di potere interno che gestisce il potere giudiziario.
Per concludere, nei giorni scorsi il Presidente dell’Anm Luca Palamara, dovendo dare prova dell’alto senso deontologico dell’Anm, cosa ha scelto di stigmatizzare? La nomina del dr Giuseppe Narducci ad assessore della giunta de Magistris.
Dovendo individuare un magistrato da additare al mondo come deontologicamente deplorevole, Palamara ha scelto Giuseppe Narducci!
